Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the MOT — Maintenance of Things website at www.maintenanceofthings.com, the application at app.maintenanceofthings.com, and all related services (collectively, the "Service"), operated by MOT — Maintenance of Things ("MOT", "we", "us", or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

MOT is an asset and maintenance management platform that allows you to track assets and equipment, log maintenance records, schedule reminders, manage maintenance projects, share asset details via public links, and transfer assets between users. The Service includes AI-powered features such as receipt scanning to automatically extract data from uploaded documents.

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 16 years old to create an account. By registering, you represent that you meet this age requirement.

4. Subscriptions and Pricing

4.1 Plans

The Service is available under multiple plans, including a free Starter plan and paid plans with additional features and higher usage limits. Plan details and pricing are listed on our pricing page.

4.2 Billing

Paid plans are billed on a recurring monthly basis. By subscribing to a paid plan, you authorize us to charge your provided payment method on each billing cycle. All fees are in US dollars unless otherwise stated.

4.3 Changes to Pricing

We may change our pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle following at least 30 days' notice.

4.4 Refunds

Paid subscriptions are non-refundable except where required by applicable law. You may cancel your subscription at any time, and you will retain access to paid features until the end of your current billing period.

5. Your Content and Data

5.1 Ownership

You retain all ownership rights to the data and content you upload to the Service, including asset information, maintenance records, images, documents, and files ("Your Content"). We do not claim ownership of Your Content.

5.2 License to Us

By uploading Your Content, you grant MOT a limited, non-exclusive, worldwide license to store, process, display, and transmit Your Content solely to operate and provide the Service. This includes processing uploaded files through AI receipt scanning when you use that feature. This license terminates when you delete Your Content or your account.

5.3 Your Responsibilities

You are responsible for:

  • Ensuring you have the right to upload and share any content you add to the Service
  • The accuracy of the data you enter
  • Managing who has access to your content through share links and transfers
  • Maintaining your own backups of critical data

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Upload content that infringes on the intellectual property rights of others
  • Upload malicious files, viruses, or harmful content
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service in any way that could damage, disable, or impair it
  • Use automated systems (bots, scrapers) to access the Service without our written permission
  • Resell or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate these terms.

7. Public Share Links

When you create a public share link, the associated asset or item data becomes accessible to anyone who has the link URL. You are responsible for managing your share links, including setting expiration dates and deactivating links when they are no longer needed. MOT is not responsible for any consequences of data shared through links you create.

8. Asset Transfers

When you transfer an asset to another user, that user gains access to the asset and its associated data. Transfers are recorded in the asset's history. Once a transfer is completed, you may no longer have access to the transferred asset depending on your role in the subscription.

9. AI Receipt Scanning

The AI receipt scanning feature processes uploaded documents to extract data such as costs, line items, and dates. While we strive for accuracy, AI-extracted data may contain errors. You are responsible for reviewing and verifying any data generated by this feature before relying on it.

10. Service Availability

We strive to keep the Service available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MOT and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or available without interruption.

13. Indemnification

You agree to indemnify and hold harmless MOT and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may close your account at any time by contacting us at support@maintenanceofthings.com.

We may suspend or terminate your access to the Service at any time if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MOT operates, without regard to its conflict of law provisions.
